The Recording Division handles all the duties the Clerk is responsible for as the County Recorder. Documents are “recorded” and become Official Records of St. Johns County. The public can view these documents at our offices or online. Some documents may not be viewable online due to privacy laws. 

Submit documents in-person, via mail, or through E-Recording vendors. 

E-Recording provides a secure way for customers to submit documents online by using an approved vendor to upload them directly to the Clerk’s Office. No specialized equipment is needed, just a computer with internet access and a scanner. Your original documents remain in your possession throughout the entire process.

To use E-Recording, documents must be submitted through a third-party vendor. We encourage customers to research the available vendors and choose the one that best suits their needs. A list of approved vendors is provided below in alphabetical order. Please note that the Clerk’s Office does not endorse or recommend any specific vendors.

IMPORTANT NOTICE: The Clerk’s Office cannot provide legal advice or assistance in preparing your document. The following are basic requirements to have a document recorded, however, we cannot advise if your document is prepared according to your wishes. If you are unsure, we suggest speaking with an attorney to be sure your best interests are considered. All documents to be recorded in person or by mail must have original “wet-ink” signatures.

Deed:
To record a deed, the document must have:

  1. Prepared by statement on the top left corner of the first page.  Name and address of who prepared the document
  2. Grantor Name
  3. Grantee Name
  4. Consideration amount
  5. Legal description of the property
  6. Grantor Signature
  7. Two witness signatures
  8. Witness names and addresses clearly printed beneath signatures
  9. Document must be notarized
  10. Recording Fees and Documentary Stamp Tax payable to the Clerk of Court (see fees)


Notice of Commencement
:
The following are required to record a Notice of Commencement:

  1. Property Owner’s Name and Address
  2. Address of Property
  3. Legal Description of Property – (lot/block/subdivision or unit/parcel/tract)
  4. General Description of Improvement
  5. Contractors Name and Address
  6. Signature of Property Owner
  7. Date of Signature
  8. Notarized with Notary signature and stamp


Contest of Lien
:
A contest of Lien must be recorded by mail or in person as the clerk must stamp proof of service prior to recording the document. This document cannot be e-recorded.

In addition to the recording fees for the document, please note the following fees:

  • Clerk proof of service sign & seal (per party being served) – $5.00
  • Postage for certified mail service on Lienee (per party being served) – $6.80
  • Copy of document being served (per party being served, per page) – $1.00

Notary: To have a document notarized, the person whose signature requires notarization must appear in person at the Clerk’s Office. The following conditions must be met. 

  1. The signer must present a current, valid government- issued photo ID. 
  2. The signer must be at least 18 years of age. 
  3. The notary must witness the signing of the document in person. 
  4. The document must not contain any blank fields. If any fields cannot be filled in, the signer must write “N/A” in those spaces.


Notaries employed by the Clerk’s Office are not authorized to notarize the following types of documents
: 

  • Last Wills and Testaments
  • Documents written in any language other than English
  • Any document that appears incomplete
  • Notarial or Apostille Certifications
  • Documents without a jurat or notarial certificate that conforms to F. S. 117.05
  • Documents via electronic notarization
  • Prenuptial Agreements
