The Criminal Division handles Felony, Misdemeanor, Criminal Traffic, County and Municipal Ordinances.

The Clerk is responsible for calendaring all criminal cases which go to court, attending each court session, recording the disposition of the court, and reporting all required information to the proper authorities. All forms can be accessed in our Forms Library.

To request copies directly from the Clerk’s Office, please submit the Request for Criminal Research document found in our Forms Library to our office via mail or email. The request may be submitted by email without the form, if the required information is noted in the email. The fees for copies and certification are listed within the research request form.

Felonies are classified into the following degrees:

  • Capital Felony is punishable by death or life imprisonment without eligibility for parole.

  • Life Felony is punishable by a term of life imprisonment and a fine not to exceed $15,000.00.

  • First Degree Felony is punishable by a term of imprisonment not to exceed 30 years and a fine not to exceed $10,000.00.

  • Second Degree Felony is punishable by a term of imprisonment not to exceed 15 years and a fine not to exceed $10,000.00.

  • Third Degree Felony is punishable by a term of imprisonment not to exceed 5 years and a fine not to exceed $5,000.00.

  • Some felony charges carry additional mandatory minimum confinement, fines, and other penalties.

  • Classification status as a Habitual Offender may result in the court imposing an extended term of imprisonment.

Misdemeanors are classified into two degrees:

  • First Degree Misdemeanor is punishable by up to one year in the County jail.

  • Second Degree Misdemeanor is punishable by up to 60 days in the County jail.

  • Some misdemeanor offenses in which the violator has not been arrested may be resolved by paying a fine in lieu of a court appearance and a withhold adjudication of guilt is applied. In accordance with Administrative Order CR-2017-005-SC, this applies to the following violations.

  • Included in each of these payable amounts are costs of prosecution in the amount of $50.00 (see F. S. 938.27).
  • There is an additional 3.5% charge if paying via credit card that is not reflected in the above amounts.
  • Alleged violators who fail to pay the monetary penalty listed above or request a court date within 30 days of the date the citation was issued, are to be set for arraignment before a County Court Judge.
