The Circuit section of the Criminal Division keeps records for the court system primarily related to Felony offenses, but may also include misdemeanor and criminal traffic charges.  Felony cases are crimes of a serious nature, punishable by death or imprisonment in a state penitentiary.

Felonies are classified into the following degrees:

  • Capital Felony is punishable by death or life imprisonment without eligibility for parole.

  • Life Felony is punishable by a term of life imprisonment and a fine not to exceed $15,000.00.

  • First Degree Felony is punishable by a term of imprisonment not to exceed 30 years and a fine not to exceed $10,000.00.

  • Second Degree Felony is punishable by a term of imprisonment not to exceed 15 years and a fine not to exceed $10,000.00.

  • Third Degree Felony is punishable by a term of imprisonment not to exceed 5 years and a fine not to exceed $5,000.00.

  • Some felony charges carry additional mandatory minimum confinement, fines, and other penalties.

  • Classification status as a Habitual Offender may result in the court imposing an extended term of imprisonment.
